The decision to remove Article 370 from Jammu and Kashmir will remain intact: CJI said in the Supreme Court

Jaipur, December 11, 2023.

The decision to remove Article 370 from Jammu and Kashmir will remain intact. A bench of 5 judges of the Supreme Court gave this decision on Monday. CJI Chandrachud said – Article 370 was temporary. It was brought for a fixed period of time.

Every decision taken by the Center cannot be challenged in the court. Doing this will spread anarchy.

The CJI said that only if the Centre’s decision is causing any kind of difficulty, it can be challenged. He also said that after Article 356, it would not be correct to say that the Center can make laws only through the Parliament. CJI said that the decision contains the judgments of 3 judges. One decision is of Chief Justice, Justice Gavai and Justice Surya Kant. The second decision is of Justice Kaul. Justice Khanna agrees with both the decisions.
